Case Summary – AIMA Application under the Transitional Regime (Manifestação de Interesse) I am seeking legal assistance regarding my residence regularisation process with AIMA, which appears to be administratively duplicated and unresolved. 1. Immigration background I previously held a temporary residence permit as a Master’s student, which is no longer valid. ( still have it) I did not complete the degree, and therefore I did not intend to renew my student residence permit. I have been living in Portugal for several years, working as a self-employed freelancer under Recibos Verdes, with: More than 2 years of contributions to Segurança Social All taxes (IRS) duly declared and paid Based on this, I qualify for the Transitional Regime (Regime Transitório) introduced by Decree-Law 37-A/2024, and I applied for a Manifestação de Interesse under the self-employed category. 2. Initial AIMA application and confusing “renewal” appointment After submitting my Manifestação de Interesse under the Transitional Regime, I received an email from AIMA inviting me to book a “renewal appointment”. Although the email referred to renewal, it also explicitly stated that it was: “Considering your registration under the transitional regime provided for in Decree-Law no. 37-A/2024…” This caused confusion, but given the reference to the transitional regime, I proceeded in good faith. I paid the requested fee I received an appointment The appointment took place on 19 September 2025 3. Appointment at AIMA (19 September 2025) Before and during the appointment, I clearly stated multiple times that: I did not want to renew my student residence permit I was applying under the Transitional Regime as a self-employed worker (Recibos Verdes) At the appointment: I explained my situation to the AIMA officer They accepted all documentation, including: Recibos Verdes IRS declarations Segurança Social contributions The officer explicitly stated that: Many applicants were in the same situation My application was acceptable I would be contacted only if additional documents were needed Otherwise, I should expect to receive my residence card by post I received no written refusal or request for clarification at that time. 4. No response after the appointment Since 19 September 2025, I have: Received no updates Received no requests for additional documents Received no decision or residence card *5. Second email requesting payment (duplicate process)* Approximately one month after the appointment, I received a new email from: manifestacao.interesse@aima.gov.pt This email: Stated that AIMA had registered my application under the Transitional Regime Requested payment in order to schedule an appointment Included a warning stating that applicants are not eligible if: - They have a residence permit that is valid or renewable - They have another ongoing regularisation process - This email appears to ignore the fact that: *I already paid* *I already attended an appointment* *AIMA already collected my full documentation* 6. Attempts to resolve the issue Since receiving that email, I don’t know what to do, if I should pay again or not and I have: Sent numerous emails (almost weekly) to aima Explained repeatedly that: I already paid, I already attended an appointment, My process was handled via the “renewal” channel but explicitly as a Transitional Regime application Received no response at all from AIMA 7. Core legal concern My concern is that: My case appears to be duplicated internally (renewals vs. manifestação de interesse) AIMA may consider my process incompatible, despite having accepted my application in person I am left in legal uncertainty, without a decision, appointment, or way to correct the administrative inconsistency 8. What I am seeking legal help with I would like legal assistance to: Clarify which application is legally valid Formally notify AIMA of the duplication and administrative error Ensure my application is assessed under the Transitional Regime (self-employed) Avoid an unjust refusal or loss of fees Understand whether a formal complaint, lawyer’s notice, or court action is advisable at this stage
